Our Privacy Policy applies to anyone with a JobsDialog account. The Policy is applicable to/available on the website. You may be required to provide personally identifiable information at several different points on our website. By accepting the policy at the time of registration, you acknowledge andconsent that we may collect, access, store, use, transfer and disclose your registration and any other information as provided by you through various means including phone call or the website as described in this Policy. Please read this statement carefully as it may affect your rights and liabilities under law. If you do not accept the Privacy Policy statement stated herein or disagree with the way we collect and process personal information collected on the website, please do not make an account or use the website.

JobsDialog Service

JobsDialog’s service allows only registered users, who have a valid login ID at JobsDialog website to upload information about their organisation and post job vacancies/ job orders. Depending on the availability of the required profiles with JobsDialog we take your order and reach out to the candidates matching the requirements specified by you. JobsDialog contacts the matching candidates and ascertains the interest of the candidate with respect to the job vacancy / job order with your organisation. Only the shortlisted CV’s matching the requirement are then mailed to you/ employers/ companies/ recruiters. The service offers two products CV pack and candidate pack.

CV pack is a product wherein CV’s of Eligible and interested candidates who are matching the job order are delivered, payment is collected 100% in advance. Products are priced basis the quantity of CV’s ordered.

Candidate pack is a product where shortlisted CV’s of eligible and interested candidates are mailed across to you when you place a job order/ job vacancy , further basis your shortlisting of the CV’s JobsDialog schedules interviews of the candidates with you and handholds the candidates till the candidate joins your company/ organisation. Payment of this product is in two parts a) Advance which is paid at the time of placing the order, b) The balance is to be paid on the day the candidate joins the organisation. The Candidate pack is priced basis the experience of the candidate joining the organisation. The experience is defined as confirmed by the jobseeker. JobsDialog does not validate / verify the total experience as mentioned by the jobseeker.

Terms of Use

This page states the "Terms of Use" under which you may access and use ‘jobsdialog.com’ (herein after referred to as the ‘JobsDialog’ or ‘the Website’’) and its products and services. JobsDialog is an on-line service, which helps Small and Medium Enterprises connect to jobseekers for employment opportunities. JobsDialog service allows subscribers – Companies , enterprises and professional organizations to effectively manage candidate sourcing – by posting job orders / vacancies and marketing their Organisation related information to jobseekers. It also helps build Organisation profiles online or through our authorised representatives operating through our contact centres.

These Terms of Use include the JobsDialog Privacy Policy,Refund Policy and Unacceptable Actions Policy which is incorporated into these Terms of Use by reference. When you agree to our Terms of Use, you are entering into a legally binding agreement with TMI e2E Academy Private Limited. With this, you agree to all of these terms of use relevant to services provided by JobsDialog. You also agree to our Privacy Policy, which covers how we collect, use, share, and store your personal information of yourself, your Organisation or your company (“you”) The Refund Policy which covers the terms under which an online payment collected from you can be refunded and to the Unacceptable Action Policy which establishes the code of conduct to be maintained by you while dealing with our office or with its authorized representatives in physical presence or on call through the contact centers. By accepting/signing in or registering, you acknowledge that you have read and understood the terms and conditions of this agreement.

JobsDialog reserves the right to revise these Terms of Use at any time by updating this section. You are advised to keep yourself updated by periodically visiting this page as the terms and conditions herein are binding on you. Jobs Dialog shall not be responsible for any consequences that may arise due to failure by a user to update himself/ herself periodically.

JobsDialog reserves the right, at its discretion to suspend or terminate access to the JobsDialog account on violation of its Privacy Policy, Refund Policy , Unacceptable Actions Policy and Terms of Use by the account holder.

As a user/subscriber of JobsDialog you are required to comply with the following obligations, some of which are obligations imposed by applicable law and regulations. As a user/subscriber, you are obligated to other Subscribers/ Employers/ Recruiters as well as JobsDialog (TMI e2E Academy Private Limited). Your acceptance of these terms and conditions confirm that you will:

  1. Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, export control laws, tax laws and regulatory requirements
  2. Provide accurate information to us and update it as necessary
  3. Review and comply with our Privacy Policy on a time to time basis
  4. Review and comply with notices sent by JobsDialog concerning the services in a timely manner
  5. Use the services in a professional manner.
  6. Use your real name on your profile as per your educational records.
  7. Abide by the terms and conditions of the current Privacy Policy, Unacceptable Actions Policy , Terms of Use, and other policies of JobsDialog. This includes respecting all intellectual property rights that may belong to third parties, such as trademarks or copyrights
  8. Keep your username and password secure and confidential and not share it with others.
  9. Not sell, trade, or transfer your JobsDialog account to another party; and will not charge anyone for access to any portion of JobsDialog, or any information therein.
  10. You hereby agree that you shall, comply with the requirements of the Information Technology Act, 2000. You further declare that in case you violate any provisions of the Information Technology Act, 2000 and/or rules, regulations, guidelines, byelaws and notifications made thereunder, you shall alone be responsible and liable for civil and criminal liability there under or under any other law for the time being in force.

Eligibility

To be eligible to use the service, you must meet the following criteria and represent and warrant that you are not currently restricted from the services, are not a competitor of JobsDialog or are not using the services for reasons that you are in competition with JobsDialog (TMI e2E Academy Private Limited).

You must be atleast 18 years of age to visit or use jobsdialog.com in any manner. You should be a registered firm/company under the Indian Partnership Act, 1932 or Companies Act, 1956 or the Limited Liability Partnership Act of 2008 and a registered member of JobsDialog service. You hereby undertake that you have obtained the necessary consent/ authorisation required from your organisation to use ‘JobsDialog’, as applicable. You will maintain only one JobsDialog account at any given point of time. You have full power and authority to enter into this agreement and doing so will not violate any other agreement to which you are a party.

You hereby undertake not to violate any rights of JobsDialog or third party, including intellectual property rights such as copyright or trademark rights and further undertake to indemnify Jobs Dialog against any such intentional or non intentional violation committed.

Jobs Dialog does not share any personally identifiable data with any third parties, as a matter of privacy policy, without obtaining the necessary consent from the users. Jobs Dialog’s services enables its users to place job orders as per the user’s requirements and based on such orders Jobs Dialog shall shortlist the CVs of eligible candidates and mail them to the user.

The User hereby acknowledges and indemnifies Jobs Dialog against any misinformation or misstatement made in the profile of the user or any other data concerning the user as provided. The user alone shall have proprietary over his/ her data and shall alone be liable for any inconsistencies/ misinformation/ misrepresentation therein.

Through JobsDialog’s contact centres you can have your personal and identifiable information updated through this service, by using the assistance of the contact centre agent or authorised representative.

You acknowledge, consent and agree that JobsDialog (TMI e2E Academy Private Limited) can disclose information about your organisation and contact details ("Company Information") to prospective jobseekers who have subscribed to the JobsDialog’s recruitment services.

You agree that JobsDialog may use your personal information to contact you and deliver information relating to the jobsdialog service to you, or provide administrative notices or communications applicable to your use of the Website.

The Website acts as a ‘connect’ between companies/employers and recruiters who are registered with us and who post job opportunities on our website and candidates who post their resumes on JobsDialog. JobsDialog is not a recruiter. JobsDialog (TMI e2E Academy Private Limited) is not to be considered as an employer with respect to your use of the Website but only a facilitator to the transaction of recruitment. It is not involved in the actual transaction between employers and the jobseeker/candidate. JobsDialog shall not be responsible for any employment decisions, for whatever reason made by any entity posting jobs on the Website. You undertake that you shall not use the service of JobsDialog for any purpose other than as an employer / Recruiter seeking employees.

JobsDialog (TMI e2E Academy Private Limited) cannot guarantee and does not have control over the quality, accuracy or legality of the resumes updated by the candidates and does not guarantee that the jobseeker would join the organisation. JobsDialog cannot guarantee or monitor the jobseekers , who register on the JobsDialog website or domains owned and operated by TMI e2E Academy Private Limited. It shall be your responsibility to conduct your own due diligence of the jobseekers before shortlisting for interviews or issuing offer letters to jobseekers to join the organisation.

You acknowledge that there are risks, of dealing with people online who are acting under false identities. JobsDialog (TMI e2E Academy Private Limited) cannot and does not confirm that each user is who they claim to be. In the event that you have a dispute with one or more users, you shall release JobsDialog (TMI e2E Academy Private Limited) its group companies and their respective officers, directors, employees and authorised representatives, from claims, demands, damages or any other form of liability (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

You acknowledge that you are solely responsible for the job order/ job vacancy on the Jobsdialog website. JobsDialog only acts as a facilitator in your recruitment process. JobsDialog will make best efforts to use the parameters provided by you in the job order / job posting to short list and select the prospective job seekers but JobsDialog takes no responsibility for the accuracy of the short listing based on the parameters for selection as specified by the subscriber. The accuracy depends on the information provided by the jobseeker registered on the JobsDialog website which may be inaccurate.

You acknowledge and consent that you shall not post, upload, submit and advertise any jobs order/ job Vacancy on the website which are discriminatory in nature and / or devoid of fair employment practice as per applicable laws and/ or any other rules, regulations relating to employment. Upon being notified to Jobsdialog by any third party or being suo moto detected by Jobsdialog that any of the user is in breach of the above requirement, if the concerned user upon the receipt of the above notice from Jobsdialog fails to either delete or amend such job posting, publication and advertisement with a period of 24 hours from such receipt, then Jobsdialog shall at its sole discretion without any other prior notice immediately delete such job posting and in doing so, the concerned user agrees and acknowledges to waive, and hereby does waive any legal or equitable rights or remedies that he has or may have against Jobsdialog.

You undertake that You shall not further disclose any of the resume’s that have been ordered by you to any third party.

The JobsDialog website contains links to third party websites. JobsDialog does not take responsibility for the content of the third-party websites and URLs, and does not make any representations regarding the content or accuracy of materials on such third party websites. If you decide to access these third-party websites, you do so at your own risk.

JobsDialog reserves all of its intellectual property rights in the service. JobsDialog and TMI e2E Academy Private Limited logos and other JobsDialog trademarks, service marks, word marks, graphics, and logos used in connection with JobsDialog are trademarks or registered trademarks of JobsDialog. Any literature/data created and published by JobsDialog on its website are exclusively copyrighted by JobsDialog. Other trademarks and logos used in connection with JobsDialog may be the trademarks of their respective owners. This agreement does not grant you any right or license with respect to any such trademarks and logos.

User Registration, Login and Password

You are solely responsible for maintaining the confidentiality of your JobsDialog account, user ID, access information and passwords. You are not authorised to share your password or other account access information with any other party, temporarily or permanently, and any breach of this obligation may tantamount to disabling of your JobsDialog account and JobsDialog services. You agree to immediately notify the Company of any unauthorised use of your account, and passwords. TMI e2E Academy Private Limited assumes no responsibility or liability for their improper use of your user ID, password or any information relating to your account access online/off-line.

You understand and acknowledge that if you close your account or if your account is terminateddue to any reason, all your account information from JobsDialog, will be marked as deleted and may be deleted from JobsDialog's databases. Information may continue to be available for some period of time because of delays in propagating such deletion across JobsDialog’s web servers. JobsDialog further reserves the right to delete your account and all of your Information after a significant duration of inactivity and reserves the right to reject and delete information/data fed in by you without assigning any reason.

You understand and acknowledge that you are prohibited from introducing/posting or transmitting information or software, which contains a computer virus, or a contaminant, worm or other harmful components on the internet or on JobsDialog (TMI e2E Academy Private Limited) site or sub-domains or on any affiliate sites or any other network system. You undertake that the services offered by jobsdialog.com shall not be utilised to upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or racially, ethnicially, or otherwise objectionable. Any conduct of the user in violation of this clause shall entitle JobsDialog (TMI e2E Academy Private Limited) to forthwith terminate all your services without any notice and further initiate appropriate legal proceedings against you. All laws applicable to public obscenity in India shall be applicable to all the users and the users alone undertake to indemnify Jobs dialog against any such charges that may arise due to the content posted by the users, for the which the user alone shall be responsible.

You expressly state that the information/data/images being fed into the network of JobsDialog by you is correct and complete in all respects and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. You undertake not to publish inaccurate information or add to a content field, content that is not intended for such field in the designated fields on the Organisation Profile as well as Account Information (e.g., do not include a link, an email address or phone number in the name field). You acknowledge and agree that you are solely responsible for the content and the accuracy of material contained therein placed by you or placed by our contact centre agent or authorised representative on your behalf on the JobsDialog website. JobsDialog has the right to make all such modifications/editing on your organisation profile .

You further agree to indemnify JobsDialog against all losses incurred by JobsDialog (TMI e2E Academy Private Limited) due to any false, distorted, manipulated, defamatory, libelous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by you on the network of JobsDialog.

JobsDialog reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter or you have agreed to receive; such offers may be made by JobsDialog or by third parties.

You are solely responsible for obtaining, at your own cost, all licenses, permits, consents, approvals and intellectual property or other rights as may be required by you for using the JobsDialog service.

JobsDialog offers a “Microsite” feature that allows Members to publish portions of their Organisation profile to the public internet and to prospective jobseekers. The organisation profile / Microsite will be designed by JobsDialog; however, all the content (logo, pictures, text, etc.) shall be provided by you. You undertake to complete the Organisation profile on priority before proceeding to job orders. You shall approve the organisation profile which has to be uploaded on the JobsDialog website before placing the job order. JobsDialog offers neither any guarantee nor warranties or any specific results that there would be any response at all once the Microsite is prepared by the contact centre /authorised representatives or by the subscriber himself by insertion of information/data on the website, jobsdialog.com. The assistance provided by the contact centre /authorised representative is purely meant to assist you in completing/ updating the necessary information and fields of information as requested on the JobsDialog website. This is provided in a best effort basis to help you in updating information about your organisation and job Orders, both these information are required to provide to jobseekers and market the organisation amongst jobsDialog subscribers.

JobsDialog (TMI e2E Academy Private Limited) will make best efforts but does not warrant that any of the web sites or any affiliate site(s) or network system linked to it is free of any operational errors nor does it warrant that it will be free of any virus, computer contaminant, worm, or other harmful components. In case while using the world wide web/internet you receive a spam or virus which includes a link to jobsdialog.com or to any other site maintained, operated or owned by TMI e2E Academy Private Limited, JobsDialog ( TMI e2E Academy Private Limited) cannot be held responsible for the same. TMI e2E Academy Private Limited assumes no responsibility for such mails.

You undertake that you will not engage in any action that directly or indirectly interferes with the proper working of our website or places an unreasonable load on JobsDialog’s infrastructure. You also undertake that you will not use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” any web pages or other services contained in the site or use bots or other automated methods to access or create accounts on JobsDialog.

You undertake that you will not access, via automated or manual means or processes, JobsDialog for purposes of monitoring JobsDialog’s (TMI e2E Academy Private Limited) availability, performance or functionality for any competitive purpose.

You undertake that you shall not lease, rent, sell/re-sell, trade access to JobsDialog or any information therein, or the equivalent, in whole or part. You confirm not to sell, sponsor, or otherwise monetize JobsDialog (TMI e2E Academy Private Limited) or any other service or functionality of jobsdialog.com, without the express written permission of JobsDialog (TMI e2E Academy Private Limited).

You undertake to notify us immediately of any changes to the personal/ organisational/ company information.

JobsDialog reserves the right to decline any application from you to register or subscribe as a user of the subscription services and/or the free services at our sole discretion. If you are accepted you will receive from us a user name and password. If you are allowed to select a user name, we reserve the right to modify such or provide you with a user name of our choice if, in our sole opinion, such user name infringes or violates the rights of any person or third party or is defamatory, offensive or is in any other way improper or inappropriate.

You undertake not to provide us with any information on our website of you and your organisation/ company which is untrue, inaccurate, out-of-date or incomplete.

You undertake that you shall not utilise or copy information, content or any data you view on or obtain from JobsDialog (TMI e2E Academy Private Limited) to provide any service that is competitive, in JobsDialog’s sole discretion, with JobsDialog. Jobsdialog reserves the right to carry out appropriate proceedings both civil and criminal against such users in order to safe guard its proprietory content and any anti trust intrusion.

You undertake that the agreement shall be effective only for the period as specified in the membership plan selected at the time of registration. JobsDialog will commence providing services on your account only upon receipt of charges upfront either from the subscriber or from a third party on behalf of the subscriber. The service shall be terminated if the subscriber fails to make payments as per the terms & condition herein.

This agreement will be extended automatically for a further period of similar duration, unless otherwise specified or terminated by JobsDialog or by you through a written communication to JobsDialog seeking withdrawal of services on or before at least 1 week from the date of expiry of the agreement.

You undertake that the JobsDialog subscription is neither re-saleable nor transferable by the subscriber to any other person, company/ corporate body/ firm or organisation.

You undertake that The subscription / agreement between JobsDialog and the subscriber / you is not a "non-poach agreement". JobsDialog is a recruitment consultancy service and may have its subscriber base as registered jobseekers who are currently employed with you/ your company/ organisation. We may reach out to them for suitable job opportunities with other employers at any time while we are in agreement with you/ your organisation/ company.

You undertake that the jobs orders/ job vacancies posted through JobsDialog’s website are genuine and in existence and that a single job order/ job vacancy posted does not have more than one job or job description, more than one location, or more than one job category.

You undertake that you shall not post a job order or jobs vacancy in a manner that does not comply with applicable local, national laws, including but not limited to laws relating to labour and employment, equal employment opportunity and employment eligibility requirements.

JobsDialog reserves its right to decline any job order / job posting or information/data provided by the Subscriber without assigning any reason whatsoever; either before placing the job order or after posting the Job Order details, but in such an eventuality, any amount so paid only for that particular vacancy, shall be refunded to the Subscriber on the basis the refund Policy except when such rejection is in due to inappropriateness of content or if there is a violation of any terms and conditions of this Agreement of usage by you.

You undertake that JobsDialog has the right to make all or any necessary modifications/editing of the vacancy / parameters or details in order to facilitate processing of the Job Order. All changes made while processing the order will be done post consultation with you.

You shall be entitled to enter details of 1 additional user who will be authorised by you to access the JobsDialog service. The authorized additional user / designated person is authorised to place orders and conduct business on behalf of the organisation with JobsDialog in relation to the Services opted by the Subscriber.

JobsDialog reserves the right to recover/charge any amounts to the Subscriber on account of any taxes levied by the Central/State Govt. on the services as contemplated in this agreement from time to time and which are not included in the total payment consideration received by the Company.

Tariff Plan refers to the details as mentioned in the Plans and Pricing page for its products, services and packages introduced by JobsDialog from time to time for providing the Services.

JobsDialog may, at its sole discretion, impose a interest equal to 18% per month on all overdue accounts.

You undertake that there will be no fee charged from any jobseeker or candidate who is contacted through JobsDialog for processing of the job order / job vacancy placed on the JobsDialog’s website.

You undertake not to call or reach out to the current employer as mentioned by the prospective jobseeker in his /her resume.

You acknowledge and undertake to respond to e-mail/SMS notifications and phone calls, promptly. Repeatedly avoiding calls from our authorised representatives will be considered as your lack of interest or waiver towards the timelines and as a result of which, delivery of your job order / job posting may be delayed.

In case you agree to conduct interviews on a specified date and time, which you have confirmed via email or on call with our authorised representative, you will honour your commitment.

If JobsDialog (TMI e2E Academy Private Limited) is able to obtain a candidate to your satisfaction, then you will make an offer within a maximum of 4 working days of confirming the same to JobsDialog.

In case the candidate accepts the offer made by You/ your Organisation, then you will inform his joining date via email / On Phone to JobsDialog (TMI e2E Academy Private Limited).

JobsDialog (TMI e2E Academy Private Limited) shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning your account.

JobsDialog would not be held liable for loss of any data technical or otherwise, insertion of information/data or particulars supplied by you due to acts of god or reasons beyond its control like corruption of data or delay or conditions that are beyond JobsDialog's reasonable control including but not limited to strikes, riots, civil unrest, government policies, tampering of data by unauthorised persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.

Any agreement for a subscription/usage entered into by you with JobsDialog (TMI e2E Academy Private Limited) does not confer exclusivity of service on you.

You acknowledge to receive access to JobsDialog’s editorial content in the form of Newsletter and you undertake that content distributed through JobsDialog sharing features (Website or Blog) and third-party integrations may result in displaying some of your personal information outside properties of JobsDialog. For example, when you post content to a JobsDialog property (Website or Blog) that is open for public discussion, your content, including your name as the contributor, may be displayed in results. Parts of your public profile are accessible to public search engines in your settings.

How we communicate with you

We communicate with you using JobsDialog notifications, email, SMS/mobile text messaging and call you on the registered mobile number available to us, by agreeing to this Terms of Use, you consent to the use your personal and organisational data in the form of e-mail/mobile/landline phone number(s) being used by JobsDialog to forward relevant information as and when they become available. We may send you email, SMS/mobile text messages or call you relating to the accessibility which relates to your registration - user ID and passwords, account and engagement related information, usability of service and its features, availability of the services or other service-related issues. We also send messages to your email and registered mobile number directly. JobsDialog tracks the open rate of your emails. These messages will be sent to you based on your profile information and messaging preferences. You may change your email and contact preferences at any time by signing into your account to opt out from receiving notifications. If you opt out, you will continue receiving service messages from JobsDialog. You may change your e-mail/SMS related notification settings by logging into your account.

Payment

We offer membership on a subscription basis with 100% advance payment. You agree to pay the applicable fees for the Services (including, without limitation, periodic fees) as they become due plus all related taxes.

Charges for the CV pack are collected 100% in advance when you place a job vacancy / job order.

In a candidate pack the payment is collected in two tranches- advance is collected in the beginning while placing the order and the second tranche is paid on fulfilment of the order/ candidate joining. You agree to honour all your payment obligations in the candidate pack and to reimburse us for all collection costs and interest for any overdue amounts. Failure to pay may result in the termination of your subscription. If the payment method you use with us, such as a credit card, reaches its expiration date and you do not edit your payment method information or cancel your account or such premium service, you authorize us to continue billing that payment method and you remain responsible for any uncollected amounts. The subscription fees paid by you is valid through the end of the subscription period. You may cancel your service, JobsDialog’s refund policy is explained here. We do not guarantee refunds for lack of usage or dissatisfaction Refund if any will be at the sole discretion of JobsDialog. The liability of the refund is limited to refund of amount only. We do not refund the service tax. JobsDialog undertakes no liability for any refund in the free membership services.

JobsDialog offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the customers card/bank accounts. If you require a printed invoice for your transaction with us, you can access it through your JobsDialog account under the My Dashboard section . You could also get all invoice / purchase details by contacting our customer support center.

TERMS RELATED TO ONLINE PAYMENTS

Online Card Payments:

Credit/Debit Card payments are processed through "Atom Technologies", an online payment gateway system or any other payment gateway system that JobsDialog may use from time to time. By using a credit/debit card to pay for our services, you confirm that the card being used is yours. Internet Banking

If you have an account with any of the banks made available for making payment by online payment gateway "Atom Technologies" or any other online payment gateway system that JobsDialog may be using, then you can pay through respective bank's net banking options and the amount will be automatically debited from your account through an online gateway system, which enables safe and secure transaction.

Transaction Confirmation

Once your transaction has been completed, you will receive a confirmation of your transaction from JobsDialog. If you do not receive a confirmation of your transaction, first look into your "spam" or "junk" folder to verify that it has not been misdirected, and if still not found, please contact us.

B. Online card payments: Auto Debit facility:

"Auto Debit facility" means the facility wherein you have authorized JobsDialog to charge your credit card for a specified amount towards your subscription fees every time your subscription fee becomes due and payable till such time as you continue to subscribe for the Services or your instruction for cancellation of Auto Debit facility or withdrawal of this facility whichever is earlier.

Credit Card payments on Auto debit basis are processed through Atom Technologies payment gateway or any other payment gateway system that JobsDialog may have an agreement with. By using a credit card to pay for our services, you confirm that the card being used is yours. All credit card holders are subject to validation checks and authorization by the card issuer.

Transaction Confirmation

Your account will be activated only after the successful completion of the initial transaction. Once your transaction has been completed, you will receive a confirmation of your transaction from JobsDialog for the initial and the subsequent payments. If you do not receive a confirmation of your payment, first look into your "spam" or "junk" folder to verify that it has not been misdirected, and if still not found, please contact us.

After the initial payment made by you, JobsDialog would, on a best effort basis send an advance notification mail every time your subscription fees become due and payable.

You may request for cancellation of auto debit service by giving 30 days notice or such period as may be specified in a particular offer. The notice should be sent to JobsDialog in writing or via email and the same will be effected within a minimum period of 7 days of the receipt of the request. The Company will not be responsible for any delays, which are beyond its control.

JobsDialog shall not be responsible for any fraudulent or disputed transactions. In case of a dispute regarding the transaction through your credit card the same must be resolved by you directly with your Credit Card issuer. You will not make JobsDialog a party to any such dispute and JobsDialog shall not be liable to you for any consequence arising out of the fraudulent or disputed transactions.

JobsDialog reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part the Auto Debit facility or to withdraw it completely.

This facility is available to Master and VISA cards issued in India.

Disclaimer:

You agree that the credit/ debit card information are of sensitive nature and are aware of the risks involved in making payment through the internet. You shall be responsible for safe keeping the credit/ debit card information and shall not share it with any other person.

JobsDialog will not be liable for any loss or damage caused by the misuse of such information due to your negligence or default.

JobsDialog as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of your having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Your Rights to Access, Correct, or Delete Your Information, and Closing Your Account

You have a right to access, modify, correct, change or delete your personal and Organisational information on your JobsDialog account at any time by editing your profile, deleting content that you have posted, or by closing your account. If you close your account, your account will be deactivated from the service within 7 working days; you may not be able to access, correct, or delete any information about you that other have copied or exported out of JobsDialog, because this information may not be in our control. We retain the personal / organisational and transactional information of yours while your account is in existence. JobsDialog (TMI e2E Academy Private Limited) will retain your personal/ organisational and transactional information even after you have closed your account or may retain information for as long as is necessary to provide support-related reporting, analysis or to comply with any regulatory, legal obligations, resolve disputes between members, prevent fraud and abuse, or enforce this Terms of Use, Privacy Policy and Unacceptable Actions Policy.

Notifications and Service Messages

By agreeing to the Terms of Use, you explicitly agree and are okay with us providing you with important notices and contacting you on the website (your account on JobsDialog), through SMS, call on your registered mobile number with us and notify you on your registered email ID with us. We may also contact you on any other alternate number provided by you to us. We would also use delivery services including the postal/courier service to connect with you about your JobsDialog account or services associated with JobsDialog.

Any unauthorized copying, reproduction, modification, distribution, public performance or public display of copyrighted works constitutes infringement of copyright of the owners’ rights. Any infringement will lead to termination of your account/ accounts with JobsDialog.

Jurisdiction and Arbitration:

Jurisdiction for any disputes arising from and related to this contest shall be Hyderabad, India to the exclusion of all other courts. All/any disputes arising out of the transactions between subscriber and JobsDialog shall be resolved in accordance with the laws of India as applicable. The disputes shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by TMI e2E Academy Private Limited. The venue of arbitration shall be Hyderabad and the proceedings of such arbitration shall be in English Language only.

Amendments in Terms of Use

JobsDialog shall have the right to amend, vary or modify the Terms of Use, Privacy Policy of JobsDialog website at any time, without giving any prior notice to you and such amendment shall be effective immediately upon inclusion/posting of such amendment on JobsDialog website.

  • JobsDialog (TMI e2E Academy Private Limited) may at its discretion and from time to time, change, add, remove features of the composition of the basic subscription services without notice.
  • The account holder/ member/ organisation shall provide the organisation details/ artwork and images as soon as possible in order to place Job orders on the website. The information provided by the SME about its organisation Profile should be accurate and not misleading in any way. The Account holder undertakes to modify and approve the organisation profile created on his behalf by the JobsDialog team.
  • The information provided on the job posting or Job Order should be followed through when the candidate is selected regarding the salary, designation etc.
  • Payments for the services offered by JobsDialog shall be on a 100% advance basis for the CV pack.
  • Payments for the services offered by JobsDialog for the Candidate pack shall be made in two parts; Part payment in advance before executing the order and the balance is to be paid on the candidate’s date of joining the organisation / company.
  • Candidate pack is priced basis the experience of the candidate. The experience is categorised under three categories 0-2 years, 2-4 years; 4-6 years. You are charged basis the experience of the candidate joining your organisation.
  • “Joining” here refers to the date on which the selected candidate has reported for work / joined the organisation, this date has been agreed upon by the candidate and your company and informed to us in advance when the offer is made. The payment must be made within a maximum of 7 days of JobsDialog raising the invoice. If the invoice is not paid for after 3 reminders then your JobsDialog account can be dis-abled by the JobsDialog team.
  • There is no guarantee of fulfilment beyond two rounds of assessments for the candidate pack.
  • This fulfilment is done on a best effort and there is no guarantee that a candidate will join you through this.
  • Each round of assessment in a candidate pack will consist of a maximum of two rounds of interviews /or evaluations.
  • JobsDialog puts in best efforts to ensure that the candidate selected by and organisation joins the organisation. However, there are no guarantees for the same.
  • Refunds would be processed as per the refund policy.
  • JobsDialog offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts. All is on a best effort basis and liability is limited to refund of amount only. JobsDialog (TMI e2E Academy Private Limited) undertakes no liability for free services.

  • Non-serviceability of an order means when there are no profiles matching your job order requirements available in our database. In such cases the order would be refunded. Please refer the Refund Policy.
